This 16-hour seminar will explore the valuation of a portion of the bundle of rights (e.g., development rights). This is a complex appraisal problem that involves dividing the value of the fee simple interests between the various ownership rights. (Remember the "bundle of rights" theory?) Conservation easements are a unique tool that enable the participants to preserve open space, control development and offer the landowner and the public a variety of perceived benefits. These types of property transfers are used to restrict use of agricultural land and recreational and timberland to the benefit of wildlife, habitats, scenic views and other perceived public benefits. Federal, state and local governments already have or are developing programs to adopt this method of land control. Hundreds of land trust organizations are also involved in acquiring this kind of partial interest in a diversity of land types throughout the United States. This seminar will provide information and guidelines to enable an appraiser to better participate in the process of valuing conservation easements.
